MIAMI (WSVN) – A second trial is underway against Robert Rips for the beating of an elderly man at the Miami Metromover on September 20, 2020.

His first trial It ended in a voided trial.

Police said the attack occurred during the journey between Stephen B. Clark Center and Omni Station, near Fernandez’s workplace.

Eduardo Fernandez, 73, testified in both cases to the beating that left him with a fractured skull and a brain hemorrhage. His cheekbones were also embedded in the sinus cavity.

The defense is expected to clash with Fernandes over his mental ability.

Rib faces charges of aggravated arm burglary and aggravated battery on a person 65 years of age or older.

Judgment will be pronounced on December 1.
